French Ban of Judges in AI

Omar Ha-Redeye and Dan McAran covered changes to Article 33 of the Justice Reform Actin France in The Lawyers Daily, preventing the use of judges names in artificial intelligence algorithm,

Artificial intelligence has often sought to mimic or copy the cognitive processes of the human mind, which can be described as a “neural network.” More complex versions of these algorithms add multiple layers between the input and output layers to create “deep neural networks.” These algorithms identify their own sources of information and even re-write themselves, through a process called deep learning.

Given our limited ability to control how deep learning algorithms function, some jurisdictions have started contemplating how to limit the use of new artificial intelligence technologies. In July 2019, France amended Article 33 of the Justice Reform Act to make it illegal to use a judge’s name for the purpose or effect of evaluating, analyzing, comparing, or predicting their professional behaviour.
